Terms of Service

#1. Who We Are

ETW Journal is a professional trading journal, performance-analytics, and accountability platform built for traders using ICT (Inner Circle Trader) and Smart Money Concepts methodologies, as well as traders of any other style or discipline. We provide tools to log and import trades, track performance metrics, analyse trading psychology and behaviour, plan sessions, keep notes, replay and backtest, receive AI-assisted insights, generate reports and certificates, take part in journaling competitions, and build consistent discipline across forex, crypto, indices, futures, stocks, and other tradable instruments. ETW Journal is not a broker, exchange, prop firm, custodian, fund manager, investment adviser, or financial institution, and does not execute, place, modify, close, clear, or settle trades of any kind.

#2. Eligibility

You must be at least 18 years of age, and have the legal capacity to enter into a binding contract in your jurisdiction, to create an account, subscribe to, or otherwise use the Service. By using ETW Journal you represent and warrant that (a) you meet these requirements, (b) all registration information you submit is truthful and accurate, (c) you will maintain the accuracy of such information, and (d) your use of the Service does not and will not violate any law, regulation, broker agreement, prop-firm rule, or third-party right applicable to you. We may, at our discretion, request proof of age or identity (including before awarding any competition prize) and may suspend or terminate accounts where eligibility cannot be verified.

#3. Account Registration, Security & Devices

To use ETW Journal you must create an account using a valid email address and password, or by authenticating through a supported third-party provider (e.g., Google). You agree to:

• Provide accurate, current, and complete registration information, and keep it up to date
• Keep your login credentials, multi-factor authentication codes, EA keys, and any broker credentials confidential, and not share your account or paid access with any other person or entity
• Use only one account per individual unless we expressly authorise otherwise (e.g., a mentor/student relationship); holding several accounts to gain an advantage in any competition is prohibited
• Notify us immediately at supportetwjournal@gmail.com if you suspect unauthorised access to, or loss of, your account
• Accept full responsibility for all activity that occurs under your account, whether or not authorised by you, except where such activity results from our own gross negligence or wilful misconduct

Device limit. To protect accounts from sharing and misuse, an account may be signed in on a limited number of active devices or browsers at the same time (currently two). Signing in on an additional device automatically signs out the least recently used one. Devices that remain inactive for an extended period are released automatically. We may change this limit for security reasons.

Multi-factor authentication. Where offered, you may enable additional verification steps (such as one-time codes). You are responsible for keeping your second factor available; we may require additional identity checks before restoring access to an account that has lost its second factor.

We are not liable for any loss or damage arising from your failure to safeguard your account credentials, and we reserve the right to require you to change your password, re-verify your identity, or take additional verification steps at any time for security reasons.

#4. A Fully Paid Service — No Free Tier or Free Trial

ETW Journal is offered exclusively as a paid subscription service. ETW Journal currently offers no free tier, no free trial period, and no permanently free plan of any kind. A valid, active, and paid subscription is required to access any feature of the Service, including the trading journal, analytics, broker sync, reports, certificates, the ETW AI page, competitions, and any community or mentorship features. Until your payment has been verified, the Service will only show a subscription screen and direct you to checkout. Any reference elsewhere (including in older marketing content, cached pages, or third-party listings) to "free," "freemium," or "trial" access to ETW Journal is superseded by this Section 4 and should be disregarded. The free Expert Advisor described in Section 10 is a component of your paid subscription and is not a free tier of the Service. Likewise, bonus days earned through the Refer & Earn program in Section 16 are a reward that extends an existing or future paid subscription; they are not a free trial or free plan.

#5. Subscription Plans & What Each Includes

We currently offer three plans, Essential, Pro and Ultra, each available on monthly, quarterly, or yearly billing as shown at checkout. In summary:

• Essential includes: adding and editing trades (including pasting screenshots), the Journal, tagging, Day View, the P&L calendar, Stats & Analytics, Reports & Progress, Strategies and Playbooks, the Notebook and Session Prep (including the pre-session checklist), broker sync for cTrader, TradeLocker and DXtrade, MT5 / MT4 EA Live Sync and MT5 / MT4 history-file import, up to two independent journal accounts, access to the ETW AI page and its guided app tour, the Journal Rank and Monthly Winners competition, the public journal, and certificates.
• Pro includes everything in Essential, plus: MT5 / MT4 Direct Connect (linking your MetaTrader account with your account number, investor password and server so trades sync without an EA), conversations with ETW AI by text (chat, AI coaching and analysis) within a daily allowance shown as 500 daily AI credits, the AI Market Sentiment Briefing, Mentor Mode, Trade Replay for up to 10 trades per calendar month, Backtesting with up to 3 new sessions per billing month, one ETW University live session per calendar month, and up to three independent journal accounts.
• Ultra includes everything in Pro, plus: up to ten independent journal accounts, a larger ETW AI allowance shown as 10,000 daily AI credits, voice conversations with ETW AI (voice input and live voice sessions), unlimited Trade Replay, unlimited Backtesting sessions with an automatic cloud backup of your backtesting workspace, unlimited ETW University session bookings (subject to mentor availability), and priority support.

Plan limits. On every plan, each journal account can be linked to one MT5 / MT4 account at a time. Independent journal accounts are counted in the order they were created; if you move to a plan with a lower limit, accounts beyond that limit are locked (not deleted) until you upgrade again. Daily ETW AI allowances reset at 00:00 UTC; unused allowance does not carry over and has no cash value. "AI credits" describe the size of a plan's daily ETW AI allowance and are not a currency, token, or stored value. Monthly Trade Replay and Backtesting allowances reset at the start of the next calendar or billing month as shown in the app, and a backtesting session counts toward the allowance when it is created, even if it is later deleted. "Unlimited" features are provided for normal personal use and remain subject to the fair-use and anti-abuse rules in these Terms.

Essential subscribers can see previews of Pro and Ultra features (for example, a labelled sample of an AI briefing) and will be shown an upgrade prompt where a feature is on a higher plan. Previews and samples are illustrative only and are not live market data or personalised output. The exact feature list for each plan is the one displayed on our pricing page at the time you subscribe or renew; we may add, change, move, or retire features between plans as the Service evolves, as described in Section 22. Where a feature moves to a higher plan, we will give reasonable notice and you may cancel before your next renewal if you no longer wish to continue.

#6. Billing, Automatic Renewal, Upgrades & Cancellation

Where you subscribe to a paid plan:

• Fees are billed in advance on a recurring basis (monthly, quarterly, or yearly, as selected at checkout) and are clearly displayed to you, in the applicable currency, before you complete your purchase
• Payments are processed by our third-party payment providers (currently Gumroad, and in some regions or for some legacy subscriptions Pesapal). By providing payment information and confirming your subscription, you authorise us and our payment processor to charge the applicable fees to your chosen payment method on a recurring basis until you cancel
• Subscriptions renew automatically at the end of each billing cycle at the then-current price unless you cancel before the renewal date; we may, where required by applicable law, send you an advance reminder of an upcoming renewal
• Access is granted once your payment is verified with the payment provider. If a payment completes but the confirmation is delayed, we will attempt to verify and settle it automatically; contact support if access is not granted within a reasonable time
• Upgrading (from Essential to Pro or Ultra, or from Pro to Ultra) creates a new subscription for the higher plan with the payment provider. Your previous membership is not cancelled automatically by the provider; you are responsible for cancelling it from your payment receipt or account page so that it stops billing. We are not responsible for duplicate charges arising from a membership you chose not to cancel, although we will review genuine errors under Section 8
• You may cancel your subscription at any time through your payment receipt or account page, or by contacting supportetwjournal@gmail.com; cancellation takes effect at the end of the current, already-paid billing period, and you retain access until that period ends
• We may change our pricing or plans from time to time; for existing subscribers, any price increase will only take effect from your next renewal date onward, with reasonable advance notice via the platform or email
• If a payment fails, is declined, or is reversed, we may suspend or restrict your access until the outstanding amount is resolved, and may retry the charge using the payment method on file
• You are responsible for keeping your billing details current; we are not responsible for loss of access caused by outdated, expired, or invalid payment information
• All fees are exclusive of any applicable taxes, levies, or duties, unless stated otherwise; where our payment provider acts as merchant of record it may collect sales tax or VAT on our behalf

#7. Auto-Sync Tokens (Prepaid Add-On for MT5 / MT4 Direct Connect)

MT5 / MT4 Direct Connect relies on a third-party cloud service that charges us for each account connection, each history pull, and each hour an account is kept connected. To cover this, Direct Connect runs on prepaid auto-sync tokens, sold separately from your subscription in token packs (for example a "Daily" or "Live" pack). By purchasing tokens you agree that:

• Tokens are a prepaid service credit usable only for Direct Connect within your own ETW Journal account; they have no cash value, are not currency or a stored-value product, and cannot be transferred, sold, gifted, or exchanged
• Tokens are consumed according to the usage meter shown in the app (for example, a fee to link an account and import its history, a fee for each scheduled refresh in Daily mode, and an hourly fee while Live mode keeps the account connected). Rates are shown in the app before you connect and our server-side meter is the authoritative record of your balance
• When your balance reaches zero, syncing stops and the linked account is disconnected automatically; trades already imported remain in your journal. You may top up and reconnect at any time
• Switching between Daily and Live modes changes how quickly tokens are used; we are not responsible for a balance running out faster because of the mode you selected
• Token purchases are non-refundable and are not pro-rated, except where required by law or in the case of a billing error under Section 8. Unused tokens are forfeited if your account is closed or terminated for cause; if your subscription simply lapses, your token balance is kept for a reasonable period in case you resubscribe
• Direct Connect requires an active Pro or Ultra subscription in addition to tokens. If you move to Essential, Direct Connect stops and any linked account is disconnected, but your token balance remains on your account for use if you return to Pro or Ultra
• We may change token prices or usage rates to reflect changes in our providers' costs; changes apply only to tokens used after the change is announced in the app

#8. Refund Policy

Because ETW Journal provides immediate, continuous digital access to journaling, analytics, sync, and AI tools upon subscribing, and because computational, storage, and third-party resources are provisioned to you the moment your subscription activates or your tokens are credited, subscription fees, token purchases, and tips are generally non-refundable, including for partial billing periods, unused features, unused tokens, or a decision to stop using the Service before your billing cycle ends. Exceptions may apply where: (a) required by applicable consumer-protection law in your jurisdiction; (b) you were charged in error or were double-billed due to a technical fault; or (c) we discontinue the Service entirely before the end of a paid period, in which case we will refund the unused, pro-rated portion of your then-current billing cycle. To request a refund review, contact supportetwjournal@gmail.com with your account email and transaction details; we will respond and make a determination within a reasonable timeframe. Chargebacks or payment disputes filed without first contacting us may result in immediate suspension of your account pending resolution.

#9. Broker & Prop-Firm Connections

The Service lets you bring trades into your journal by connecting supported trading platforms (currently MT5 and MT4 via Direct Connect or the ETW EA, cTrader, TradeLocker, and DXtrade) or by importing history files (CSV, HTML, XLSX, and similar reports). By connecting an account you:

• Authorise us, and the third-party connection providers we use, to access your trading account on your behalf for read-only purposes — to read account details, balances, positions, and trade history and to import them into your journal. ETW Journal never places, modifies, or closes trades. Where a platform offers read-only or "investor" credentials, you should use those, and you must not give us credentials that allow trading or withdrawals
• Confirm you are the owner of the trading account, or are authorised by its owner, and that connecting it does not breach your broker's or prop firm's terms. Prop firms set their own rules; it is your responsibility to check that a read-only journal connection is permitted on your evaluation or funded account
• Understand that imported data comes from your broker or platform and may contain errors, omissions, delays, rounding differences, commissions or swaps reported differently, or time-zone differences; you are responsible for reviewing imported trades. We are not liable for inaccuracies in broker-supplied data or for trades missed during a provider outage
• Understand that connections depend on third-party services (your broker, the platform vendor, and our connection providers) that may change, rate-limit, suspend, or end their services at any time; we may have to pause or withdraw an integration as a result
• May disconnect at any time from the Brokers page. Disconnecting stops future syncing; previously imported trades stay in your journal until you delete them

#10. The ETW Expert Advisor (EA) & EA Keys

Subscribers may download the ETW EA and a personal EA key to sync MT5 / MT4 trades from their own trading terminal. The EA is licensed to you, not sold, for use only with your own ETW Journal account while your subscription is active. The EA runs on your own computer or VPS; you are responsible for installing it correctly, keeping your terminal running, and ensuring its use is permitted by your broker or prop firm. The EA only reads and reports your trade history; it does not trade. Your EA key identifies your account — keep it private and do not share it, publish it, or use it on accounts you do not own. We may revoke and re-issue keys if we suspect misuse. You may delete trades that were imported from a file or by the EA at any time. The EA is provided "as is" under Section 25.

#11. ETW AI, Voice Features & AI-Generated Content

ETW AI is the assistant built into the Service. Depending on your plan it may chat with you about your journal, analyse your trades, tags, notes, and session preps, produce coaching notes, reports, market briefings, trade-tag suggestions, notifications, and summaries, and accept voice input. You acknowledge that:

• AI output can be wrong. It is generated automatically by third-party large language models, may be inaccurate, incomplete, out of date, or inconsistent, and must not be relied on as fact. The Market Sentiment Briefing in particular is not live market data and is not a trading signal — always verify with live market data before trading
• ETW AI is subject to usage limits (for example, per-minute and daily caps) and may respond in a shortened form, queue, or be temporarily unavailable when limits are reached or providers are down
• To answer you, the relevant parts of your journal data and your messages (and, for voice input, your audio recording) are sent through our servers to our AI providers for processing, as explained in the Privacy Policy. Do not enter sensitive personal information (such as passwords, card numbers, or identity documents) into ETW AI
• Voice input requires your permission to use your device's microphone; audio is only captured while you are actively recording or in a live voice session. Spoken replies are generated by your own device's speech engine
• You are responsible for how you use AI output. ETW AI does not provide financial advice (see Section 13) and you must not use it to generate unlawful, harmful, or infringing content
• On Essential, the ETW AI page and app guide are available but conversations with ETW AI are not included. Pro includes text conversations within its daily allowance; voice input and live voice sessions are available on Ultra only. When the daily allowance is used up, ETW AI will tell you and conversations resume after the daily reset (00:00 UTC) or when you upgrade

#12. Acceptable Use

ETW Journal is a tool for personal trading analysis, record-keeping, accountability, and education. You agree not to:

• Use the Service for any unlawful, fraudulent, deceptive, or unauthorised purpose
• Log fabricated, copied, or automatically generated trades or journal entries, or otherwise manipulate your Journal Score, rank, or competition standing (see Section 15)
• Attempt to reverse-engineer, decompile, disassemble, scrape, or extract data, algorithms, scoring logic, or source code from our systems, the EA, or our APIs
• Probe, penetration-test, stress-test, or attempt to bypass any security, plan restriction, device limit, usage limit, token meter, or authentication measure without our prior written consent
• Write to, alter, or tamper with data, scores, or records directly (for example through browser tools or the database API) rather than through the normal use of the app
• Upload content that is unlawful, harmful, abusive, defamatory, obscene, or that infringes any third party's intellectual property, privacy, or publicity rights — including in screenshots, notes, display names, profile photos, public journals, or playbooks
• Upload malicious code, viruses, or any material designed to disrupt, damage, or gain unauthorised access to the Service or other users' data
• Share, resell, sublicense, rent, or provide access to your paid account, EA key, or the Service to any third party who has not independently subscribed
• Use automated means (bots, scrapers, scripts) to access the Service except through any API or EA we officially publish and authorise
• Impersonate any person or entity, use another person's name or photo on the leaderboard, or misrepresent your affiliation with any person or entity, including ETW
• Interfere with, disrupt, or place an unreasonable load on the integrity or performance of the Service or its underlying infrastructure

We reserve the right to investigate and take appropriate action, including content removal, score correction, competition disqualification, feature restriction, or account suspension or termination without refund, against anyone who violates this section.

#13. Not Financial Advice

ETW Journal is a journaling, record-keeping, and analytics tool only. Nothing on the Service — including statistics, scores, ranks, tags, notes, AI-generated observations, market briefings, coaching notes, certificates, mentorship content, ETW University sessions, public journals, playbooks shared by other users, competition results, or any other feature — constitutes financial, investment, tax, legal, or trading advice, nor a recommendation, solicitation, or offer to buy, sell, or hold any financial instrument, cryptocurrency, or security. A high Journal Score, rank, or competition placing measures how thoroughly you journal and is not an indication of trading skill or profitability. All trading and investment decisions are made solely by you, at your own risk and discretion. Trading financial markets, including forex, crypto, indices, and futures, involves substantial risk of loss, can result in the loss of your entire capital, and is not suitable for every investor. Past performance recorded in the journal, in ETW University sessions, or anywhere else on the Service is not indicative of future results. ETW, its founders, employees, mentors, and affiliates accept no liability whatsoever for trading losses, missed opportunities, or financial outcomes of any kind arising from your use of, or reliance on, the Service, its analytics, or any content generated by ETW AI.

#14. Journal Score & Journal Rank

The Service calculates a Journal Score (0–1,000) and a Journal Rank tier (Starter, Bronze, Silver, Gold, Platinum, Diamond) for each calendar month. The score measures how thoroughly you journal each trade — not how many trades you take and not whether they were profitable. It is made up mainly of an average per-trade thoroughness score (covering, among other things, the Add Trade fields you complete, your written narrative, lesson, mistakes and post-trade review, your screenshots, and the tags you add, with tags carrying significant weight), plus smaller parts for your Notebook notes, daily notes and session preps, and for your wider journaling activity in the app. Copy-pasted or filler text scores less than genuine reflection. The score and rank update automatically as you add or edit your journal, and reset to zero at the start of every calendar month in your own time zone; nothing carries over. At least five journaled trades in the month are needed to rank above Starter. We may refine the scoring method from time to time to keep it fair and resistant to gaming; any change applies from the month after it is announced, unless it is needed to correct an error or close an exploit. Scores and ranks are a motivational feature with no monetary value outside the Monthly Winners competition.

#15. Monthly Winners Competition — Official Rules

ETW runs a monthly journaling competition ("Monthly Winners") that rewards the most thorough journalers. These Official Rules apply in addition to the rest of these Terms.

• Nature of the competition. Monthly Winners is a competition of skill based solely on journaling thoroughness as measured by the Journal Score. It is not a lottery, sweepstakes, or game of chance, and trading profit or loss plays no part. No purchase is required beyond the subscription that gives access to the Service, and entry does not cost anything extra
• Eligibility. To be eligible for a month you must (a) be at least 18 and meet Section 2, (b) hold an active, paid ETW Journal subscription (Essential, Pro or Ultra) throughout the month and when prizes are awarded, (c) have joined the competition by creating a public leaderboard profile with a display name and opting in to appear publicly, (d) have journaled at least five trades in that month, and (e) not be an employee, contractor, or immediate family member of ETW or of the prize sponsor. The competition is void where prohibited or restricted by law, and you are responsible for confirming that taking part is lawful where you live
• Competition period. Each competition runs for one calendar month. A month closes at 12:05 UTC on the 1st day of the following month (the moment the month has ended in every time zone). Entries and edits made after the close do not count toward the closed month
• How winners are decided. Eligible participants are ranked automatically by: first, Journal Rank tier (a higher tier always beats a lower tier, so any tier from Bronze to Diamond can win); then Journal Score within the tier; then, as a tie-breaker, the number of journaled trades in the month; then average per-trade thoroughness; and finally the earliest time the qualifying score was reached. Results are calculated from each participant's own journal data and published automatically after the month closes
• Prizes. The participants placing 1st and 2nd each win a funded prop-firm trading account. The account size, prop firm, and programme are chosen by ETW and may be announced in the app; ETW may substitute a prize of equal or greater value. The participant placing 3rd receives public recognition on the podium. Prizes are personal, non-transferable, and have no cash alternative unless ETW decides otherwise. A funded account is subject to the prop firm's own terms, eligibility checks (including identity verification), trading rules, and profit-split conditions, which ETW does not control; ETW is not responsible if a winner fails a prop firm's checks or breaches its rules after the account is issued. Unless otherwise announced, no more than one prize is awarded per person per month
• Claiming a prize. We will contact winners using the email on their account and in the app. Winners must respond and complete any verification we reasonably require (such as confirming identity, age, eligibility, and that the winning journal entries are genuine) within 14 days of first contact, or the prize may be forfeited and offered to the next eligible participant. Any taxes, fees, or reporting obligations arising from a prize are the winner's responsibility
• Verification & disqualification. Scores are calculated in the app and checked by validation rules on our servers. We may review any participant's journal to confirm that entries reflect genuine trades and genuine reflection. We may adjust a score, withhold or reclaim a prize, disqualify a participant, and/or suspend the account if we reasonably believe there has been manipulation, including fabricated or duplicated trades, scripted or copy-pasted entries, use of multiple accounts, tampering with scores or records, exploiting bugs, or any other breach of these Terms. Our decisions on scoring and eligibility are final, subject to applicable law
• Publicity. By opting in you agree that your display name, profile photo (or initial if you have none), rank tier, score, journaled-trade count, and placing may be shown on the public Monthly Winners page and inside the app, including after the month ends, and that ETW may announce winners by these details. You can turn off your public profile at any time; doing so removes you from future competitions until you opt in again, but does not remove results that have already been published
• Announcements. We promote the competition through in-app cards and notifications several times a month and announce winners after each month closes. You can manage in-app notifications through the Notifications page
• Changes. ETW may modify, suspend, or end the competition, its prizes, or these Official Rules at any time, including where fraud, technical failure, or other factors affect its integrity. Changes will not reduce a prize already won. Questions about the competition can be sent to supportetwjournal@gmail.com

#16. Refer & Earn Referral Program — Program Rules

ETW runs a referral program ("Refer & Earn") that rewards subscribers who introduce new traders to ETW Journal with additional days of subscription access ("bonus days"). These Program Rules apply in addition to the rest of these Terms. You can find your personal referral link and code, your rewards, and the status of the people you invited under Settings → Refer & Earn in the app.

• Who can refer. Any ETW Journal account holder who meets Section 2 receives a personal referral code and link. Complimentary, staff, test, or promotional accounts may be excluded from earning rewards
• Who can be referred ("referred friend"). A referred friend must be a new customer: a person who has never held a paid ETW Journal subscription under any account. The friend must open your referral link, or enter your code in the app, before making their first payment. A referral that is recorded after the friend's first payment does not count
• One referrer per friend, permanently. Each account can be linked to only one referrer. Once recorded, a referral cannot be moved to another referrer, removed, or re-entered with a different code
• Rewards. When a referred friend's first payment for a subscription is confirmed by our payment provider, the referrer earns bonus days as follows: 7 bonus days if the friend subscribes to Essential; 15 bonus days if the friend subscribes to Pro or Ultra; and an additional 5 bonus days on top of either amount if the friend chooses quarterly or yearly billing. The most a referrer can earn from a single referred friend is therefore 20 bonus days (Pro or Ultra on quarterly or yearly billing)
• Upgrades and renewals. Renewals of a referred friend's subscription do not earn further rewards. If a referred friend later moves to a plan or billing cycle that carries a higher reward (for example from Essential to Pro or Ultra, or from monthly to yearly), the referrer receives only the difference between the new reward and the reward already earned for that friend, so the 20-day maximum per friend still applies
• No limit on friends. There is no cap on the number of friends you can refer, and bonus days from different friends add up. We may, however, review, delay, or decline rewards that appear unusual or abusive, as described below
• How bonus days are applied. If your subscription is active, bonus days extend your current access period automatically. If your subscription is not active when you earn them, they are saved to your account and added to your next paid subscription period. Bonus days that have not yet been used when your subscription renews are carried forward to the new period. Bonus days extend access to the plan you hold at the time; they do not upgrade you to a different plan, change your billing date with our payment provider, or reduce or pause any payment you owe
• Referred friends. Referred friends pay the normal price of the plan they choose. Unless we announce otherwise in the app, the program does not give the referred friend a discount, free days, or other benefit
• Refunds, chargebacks, and reversals. If a referred friend's payment is refunded, charged back, cancelled as fraudulent, or otherwise reversed, the bonus days earned from that payment are removed. Where those days have already been added to your access period, we may shorten your current access period or deduct them from bonus days or paid periods you receive later
• Self-referrals and duplicate accounts are not allowed. You may not refer yourself, a second account of yours, or an account you control, and payments made with an email address that matches the referrer's account (including variations of the same address) do not earn rewards. You may not create accounts, use disposable or fictitious identities, or arrange purchases solely to generate rewards
• How you may share your link. Share your referral link or code honestly and personally — for example with people you know, in your own communities, or on your own social media accounts. You must not send spam or unsolicited bulk messages; post your link on coupon, deal, or cashback sites; buy search or social ads that use the "ETW," "ETW Journal," or "Ethereum Wizard Trades" names; impersonate ETW or present yourself as acting on its behalf; or make false or misleading statements about the Service, its features, its prices, or trading results. You are responsible for complying with any laws and platform rules that apply to how you share your link
• No cash value. Bonus days are a promotional service credit only. They have no cash value and cannot be sold, transferred, exchanged for money, tokens, or other products, or combined into a refund. Bonus days do not entitle you to a refund under Section 8, and they are forfeited if your account is closed or terminated for cause
• Verification and abuse. Rewards are calculated by our servers from verified payment records, and our records are the authoritative account of the referrals and bonus days on your account. We may review any referral, withhold or reverse rewards, close referral codes, remove you from the program, and/or suspend your account under Section 24 if we reasonably believe the program has been abused or these rules have been broken
• Taxes. You are responsible for any taxes or reporting obligations that may arise from rewards you receive
• Changes. ETW may change the reward amounts, modify these Program Rules, or suspend or end the program at any time, with notice in the app. Changes apply to referrals whose first payment is confirmed after the change takes effect; bonus days already added to your account are not removed because of a change, except where they are reversed under these rules. #17. Public Journal, Shared Content, Mentors & Community Features

• Public journal & sharing. If you publish your journal, playbooks, trades, certificates, or leaderboard profile, the content you choose becomes visible to anyone with the link (and, for leaderboards, to the public). You are responsible for what you choose to publish, including making sure screenshots do not reveal account numbers or other details you want to keep private. You can unpublish at any time, but copies others have already made are outside our control
• Mentor Mode. When you accept a mentor or student connection, you allow the other party to view the parts of your journal, trades, and playbooks that the feature exposes, and to exchange messages with you. Only connect with people you trust, and remove the connection when you no longer want to share. Mentors are independent users, not ETW staff, unless clearly identified as ETW
• ETW University & educational content. Lessons, live sessions, and other educational materials are for general education only and are subject to Section 13
• Tips. Voluntary tips ("Buy me a coffee") are processed by our payment provider, do not unlock features, and are non-refundable

#18. User Content & Data You Submit

You retain ownership of the trade data, imported broker history, notes, screenshots (including images you paste from your clipboard), playbooks, session preps, checklists, tags, messages, and other content you submit to the Service ("User Content"). By submitting User Content, you grant ETW a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, back up, transmit to our sub-processors (including AI providers when you use AI features), and display that content solely for the purpose of providing, securing, and improving the Service to you, calculating your Journal Score, running the competition, and (where you affirmatively use a public-sharing, leaderboard, or mentor feature) displaying it to the audience you choose. You represent that you have all rights necessary to submit your User Content and that it does not infringe any third party's rights. We do not claim ownership of your User Content, do not sell it, and do not use it to train our own or third-party AI or machine-learning models.

#19. Intellectual Property

All content, design, branding, source code, scoring methods, guided-tour materials, EA software, and other software comprising ETW Journal — including the "ETW," "ETW Journal," "ETW AI," and "Ethereum Wizard Trades" names, logos, emblems, and trade dress — are the property of ETW or its licensors and are protected by copyright, trademark, and other intellectual property laws. Third-party names and logos shown in the Service (such as MetaTrader, cTrader, TradeLocker, DXtrade, TradingView, and prop-firm names) belong to their respective owners and are used only to identify compatible services; their use does not imply endorsement. Except for the limited, non-transferable right to use the Service as intended under a valid subscription, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any part of the Service without our prior written permission.

#20. Feedback

If you send us feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, royalty-free licence to use that feedback for any purpose, including improving the Service, without any obligation to compensate or credit you.

#21. Data, Privacy & Notifications

Your trade data and personal information are handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We do not sell your personal data to third parties. The Service sends in-app notifications and cards (for example, sync results, rank-ups, competition announcements, winner announcements, AI insights, and the guided app tour that opens automatically a short time after your subscription is first verified). With your browser's permission it may also send push notifications, which you can turn off at any time in your browser or device settings.

#22. Service Availability, Modifications & Beta Features

We aim to keep ETW Journal available at all times but do not guarantee uninterrupted, error-free, or secure access, and scheduled or emergency maintenance may temporarily limit availability. We may modify, add, remove, suspend, move between plans, or discontinue any feature of the Service (including integrations, AI features, the EA, and the competition), temporarily or permanently, for reasons including maintenance, security, legal compliance, changes by third-party providers, or product changes. Where a change materially reduces what your paid plan includes, we will give reasonable notice where practicable. Features labelled "beta," "preview," "sample," or "experimental" are provided for testing or illustration purposes, may be unstable, and may be changed or removed at any time without liability to you. The installable (PWA) version of the app may cache parts of the Service on your device to work offline; cached data may be out of date until you reconnect.

#23. Third-Party Services & Integrations

The Service relies on and integrates with third-party infrastructure, AI, data, and payment providers — including Google Firebase, Cloudinary, Netlify, Render, Groq, MetaApi, TradingView, Gumroad, and Pesapal — and with third-party trading platforms (such as MetaTrader 4/5, cTrader, TradeLocker, and DXtrade) and prop firms where you choose to use them. We are not responsible for the availability, performance, security, accuracy, or practices of these third parties, each of which is governed by its own terms and policies, and your use of a third-party platform remains subject to your agreement with that provider.

#24. Termination & Suspension

We reserve the right to suspend or terminate your account, restrict features, disconnect linked broker accounts, revoke EA keys, disqualify you from competitions, or remove you from the Refer & Earn program and reverse referral rewards, with or without notice, if you violate these Terms, engage in fraudulent, abusive, or unlawful behaviour, fail to pay applicable fees, or if required by law. Termination for cause does not entitle you to a refund of amounts already paid (including unused tokens), except as described in Section 8. You may delete your account and stop using the Service at any time by contacting us through the channels below. Upon termination, your right to access the Service ceases immediately, any linked broker accounts are disconnected, and certain data may be retained as described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (including Sections 7, 8, 13, 15, 16, 18–20, and 25–29) will survive.

#25. Disclaimer of Warranties

The Service, the EA, broker integrations, AI features, scores, and competition systems are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, accurate, complete, or free of errors, bugs, or data loss, that imported broker data will be complete or correct, or that any errors will be corrected. You use the Service, and rely on any analytics, scores, or AI-generated content within it, entirely at your own risk. Please keep your own records of important trading data.

#26. Limitation of Liability

To the fullest extent permitted by law, ETW, its founders, employees, mentors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, prizes, or trading losses (including any loss on, or failure to obtain or keep, a prop-firm account), arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. Our total aggregate liability for any and all claims arising from or relating to these Terms or the Service shall not exceed the total amount you actually paid us (including for tokens) in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

#27. Indemnification

You agree to indemnify, defend, and hold harmless ETW and its founders, employees, mentors, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your connection of any trading account, your participation in any competition, your violation of these Terms, or your violation of any right of a third party or any broker or prop-firm agreement.

#28. Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labour disputes, power or internet outages, governmental action, or failures of third-party infrastructure, AI, broker, connection, or payment providers.

#29. Governing Law & Dispute Resolution

These Terms are governed by, and will be construed in accordance with, applicable law, without regard to conflict-of-law principles. Before pursuing formal legal action, you agree to first contact us at supportetwjournal@gmail.com to attempt to resolve any dispute informally and in good faith. Nothing in this section limits either party's right to seek injunctive or equitable relief where appropriate, or to bring a claim in small-claims court where available.

#30. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

#31. Entire Agreement; No Waiver

These Terms, together with our Privacy Policy, the Monthly Winners Official Rules, the Refer & Earn Program Rules, and any additional terms presented to you for specific features, constitute the entire agreement between you and ETW regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

#32. Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganisation, or sale of assets.

#33. Notices

We may provide notices to you via the email address associated with your account, through in-app notifications and cards, or by posting on the Service. It is your responsibility to keep your account email address current so that you receive important notices, including billing, renewal, token, referral-reward, and competition-prize notices.

#34. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, our business, or applicable law. We will indicate the effective date of the latest revision above, and where changes are material, we will provide reasonable notice via the platform or email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms; if you do not agree to the revised Terms, you must stop using the Service and may cancel your subscription as described in Section 6.
